1. About ELITEFXHUB
ELITEFXHUB ("we", "us", "the Platform") is a digital forex education and mentorship platform operated by ELITEFXHUB Ltd. We provide courses, tools, journaling systems, and mentor marketplace services. We do not execute trades, hold client funds, or provide licensed investment advice.
2. Eligibility
You must be at least 18 years old to use the Platform. By registering, you confirm you meet this requirement and understand that all courses and platform resources are provided solely for educational and training purposes.
3. Educational Purpose Only
All content (including courses, mentor sessions, AI analysis, and educational trade setups) is for learning purposes only. Nothing on the Platform constitutes financial, investment, or trading advice. You are solely responsible for your trading decisions.
4. Subscriptions & Payments
ELITEFXHUB provides free starter access, paid plans (Starter, Pro and Elite, each bought for a month or a year at a time), individual course purchases, and live mentor sessions that are included in your plan's monthly allowance. • Plan periods, no automatic renewal: Each payment buys one plan period (one month or one year). Plans do not renew automatically, and we never charge your card, M-Pesa or wallet without you approving the payment. We email you 3 days before your period ends. To continue, pay for the next period from Billing; paying early adds the new period after the current one, so you lose no days. If you do not pay, your account moves to the Free plan when the period ends, and your journal and course progress are kept. • Prices and currency: Plan prices are set in Kenyan shillings (KES) with US dollar (USD) equivalents. M-Pesa payments are charged in KES; card payments may be charged in USD. Your receipt shows the amount and currency actually charged and, where a price was converted, the rate used. • Stopping a plan: Because nothing renews automatically, you do not need to cancel to avoid a charge. You can choose Cancel in Billing to stop renewal reminders; you keep full access until the end of the period you paid for. We do not give partial refunds for unused days. • Payment methods: We accept major credit and debit cards (Visa, Mastercard, American Express) processed through PCI-DSS Level 1 compliant processors (Stripe), mobile money (M-Pesa via licensed payment service providers) and your ELITEFXHUB wallet balance. ELITEFXHUB does not store your card security codes (CVV/CVC) or mobile money PINs. • Taxes: Applicable statutory taxes, including Value Added Tax (VAT) and digital services taxes where mandated by the Kenya Revenue Authority (KRA) or your local tax jurisdiction, are included in the price shown at checkout and itemised on your receipt. • Failed payments: If a payment you start does not go through (for example, an M-Pesa request that is declined or times out), nothing is charged and your current access is unchanged. You can try again from Billing. • Refunds: Refunds follow our Refund Policy (/legal/refunds). In short: the first payment for a plan can be refunded within 7 days if you have not attended a live mentor session since paying; a course can be refunded within 30 days if you have completed less than half of its lessons; renewals are not refunded; and self-service refunds are limited to 3 in any 12 months. Opening a payment dispute or chargeback without first contacting support may result in your account being suspended.
5. Discipline Rules
The Platform includes educational risk-management simulations including pre-flight checklists, simulated loss limits, cooldowns, and demo practice requirements. These training tools exist to teach professional habits and structured discipline.
6. Mentor Marketplace
Mentors are independent educators. ELITEFXHUB does not guarantee mentor outcomes. Mentor coaching packages and educational setup reviews are educational services, not signal or investment advisory services.
7. Broker Referrals
Our Broker Chooser lists regulated brokers for informational purposes. For Kenyan users, we prioritize CMA-licensed brokers. We may receive affiliate commissions; see our Affiliate Disclosure.
8. Prohibited Conduct
You may not: promote guaranteed returns; resell Platform content without permission; harass other users; use the Platform for unlicensed investment advisory; or misrepresent your trading results.
9. Limitation of Liability
ELITEFXHUB is an educational platform and is not liable for personal trading decisions or outcomes outside the platform. Content, mentor commentary, and training examples are for learning purposes only. Past performance of educational examples does not guarantee future results.
10. Governing Law
These Terms of Service, and any non-contractual obligations, claims, or disputes arising out of or in connection with them, your account, or the Platform, shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles. • Good-Faith Negotiation: Before initiating formal proceedings, the parties agree to attempt in good faith to resolve any dispute informally. The claimant must deliver a written Notice of Dispute describing the claim and desired remedy to [email protected]. Both parties shall engage in good-faith negotiations for a minimum of thirty (30) calendar days from receipt. • Mediation: If the dispute is not resolved through negotiation within thirty (30) days, the parties agree to submit the dispute to confidential mediation administered under the Mediation Rules of the Nairobi Centre for International Arbitration (NCIA) or the Chartered Institute of Arbitrators (CIArb Kenya Branch). For international users or remote mentors, mediation sessions may be conducted virtually via secure videoconference. • Binding Dispute Resolution & Jurisdiction: If mediation does not resolve the dispute within sixty (60) calendar days from commencement, the dispute shall be finally determined either by binding arbitration under the Arbitration Act (Chapter 49 of the Laws of Kenya) or the NCIA Arbitration Rules, or submitted to the exclusive jurisdiction of the competent commercial courts of the Republic of Kenya sitting in Nairobi. • Class Action Waiver: To the fullest extent permitted by applicable law, all claims must be resolved on an individual basis. Neither party may initiate or join a class action, consolidated action, or representative proceeding against the other. • Statutory Rights: Nothing in these Terms limits or excludes any non-waivable statutory consumer protections guaranteed by the mandatory laws of your jurisdiction of habitual residence.
